The simple answer to the question is yes. You can use instant
screening devices in any state. The key to using these types of
drug and alcohol screens is having positive or "non-negative" confirmed
by a nationally certified laboratory such as NIDA or SAMHSA. The
results of the confirmation test require that an MRO(Medical Review
Officer) verify the results. This protects employers from
frivolous litigation by people not hired for testing positive on a
pre-employment or random drug screen.
Do I need a consortium to do my DOT drug screening?
No:
This is a commonly held belief among companies who are required to be
DOT compliant. The truth is you can use any TPA(Third Party
Administrator), including consortiums. As long as all the regulations
in CFR 49 Part 40 are followed, then anyone can be used. Consortiums
were established to provide companies with less expensive methods for
testing and to pool companies together for testing reasons. As an
employer you're required to do the minimum testing requirements set
forth yearly by the DOT, so you're not gaining any advantage from that
means. Also, with advancements in drug testing technology, it's now
much less expensive to have testing done.
